2.  If you have a small estate, will a part (perhaps bigger part) of your assets go to probate/legal fees?

One of the biggest myths of the law today, is that smaller estates do not need to do estate planning.  Nothing could be further from the truth.   Lawyers fees, magnified by family feuding in the last and current decade over small estates could result in much of the assets being lost in the legal system and not passing to the desired beneficiaries.  This is totally avoidable with proper estate planning for estates of all sizes, especiall smaller estates. It is most important to work with a team of professionals to assure your estate plan is reviewed and prepared correctly and according to your wishes.
